Terms of Service

1. Who may use PorchPing

You must be at least 13 years old and able to enter a legally binding agreement. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. You may use the Service only in the United States and in compliance with applicable law.

2. What the Service does

PorchPing monitors selected publicly available local-government meeting materials and may send alerts based on topics and places you save. Coverage is limited to the locations and sources we choose to monitor and may change at any time. The Service may be free, offered as a preview, or subject to additional terms and fees disclosed before purchase.

Alerts and summaries are provided for general informational purposes. They may be generated or assisted by automated systems and may be incomplete, delayed, unavailable, or inaccurate. Always review the linked official source and contact the relevant public body to confirm deadlines, meeting details, legal notices, and official actions.

3. Not professional or emergency advice

The Service does not provide legal, financial, land-use, real-estate, safety, or other professional advice. A nearby item does not necessarily affect, concern, or change the legal status or value of a property. PorchPing does not predict outcomes or guarantee that you will receive notice of any matter.

Do not rely on PorchPing for emergencies, evacuation notices, severe-weather warnings, public-safety instructions, statutory notice, or any time-sensitive government communication. Use 911 or official emergency and government channels when appropriate.

4. Your account and saved information

You agree to provide accurate, current information; keep control of your email account and mobile device; and promptly update information that changes. You are responsible for activity performed through your account and for telling us promptly if you believe it has been accessed without permission.

You may save only addresses and other places that you are authorized to use for receiving personal alerts. Do not use the Service to monitor, harass, stalk, profile, or threaten another person, or to infer sensitive information about them.

5. Email and text messages

You may separately choose email alerts, SMS alerts, or both. Your consent to receive automated text messages is not a condition of purchase. Message frequency varies, and message and data rates may apply. You can withdraw consent at any time. Our Email & SMS Terms contain the full messaging terms and are incorporated into these Terms.

6. Acceptable use

You may not: break the law; impersonate another person; interfere with or overload the Service; bypass access controls; introduce malicious code; scrape, crawl, or use automated means to access the Service without our written permission; reverse engineer the Service except where law permits it; use Service content or outputs to build or train a competing service or model; resell the Service; or use the Service to violate another person’s privacy or rights.

You may not misrepresent a PorchPing alert or summary as an official government record or communication. Links to public records remain subject to the terms and rights of their source.

7. Ownership and feedback

The Service, including its software, design, branding, and original content, is owned by VoteVoteWin LLC or its licensors and is protected by law. Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable right to use the Service for your own noncommercial purposes.

If you provide feedback, you give us a perpetual, worldwide, royalty-free right to use it without restriction or compensation. This does not give us ownership of your personal information.

8. Third-party sources and services

The Service links to and depends on third-party websites, public records, telecommunications networks, mapping or geocoding tools, and other providers. We do not control and are not responsible for their content, availability, accuracy, security, or practices. Your use of a third-party service may be governed by its own terms.

9. Suspension, termination, and changes

You may stop using the Service, unsubscribe, or request account deletion at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or misuse the Service. We may change, limit, or discontinue any part of the Service. Where reasonably practical, we will provide notice of a material adverse change.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” PorchPing disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and that the Service will be uninterrupted, secure, complete, or error-free. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, VoteVoteWin LLC and its owners, affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or use, arising from or related to the Service—even if advised that such damages are possible.

To the fullest extent permitted by law, their total liability for all claims arising from or related to the Service will not exceed the greater of $100 or the amount you paid PorchPing during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

12. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless VoteVoteWin LLC and its owners, affiliates, officers, employees, contractors, and agents from third-party claims, damages, losses, and reasonable legal fees arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person’s rights.

13. Governing law and disputes

These Terms are governed by Florida law, without regard to conflict-of-laws principles. Any dispute that is not resolved informally must be brought exclusively in the state or federal courts located in Bay County, Florida, and you and PorchPing consent to their jurisdiction. Before filing a claim, each party agrees to send written notice describing the dispute and requested relief and allow 30 days for an informal resolution. Nothing here prevents either party from seeking emergency injunctive relief or using small-claims court where eligible.

We are not requiring arbitration or a class-action waiver in these Terms.

14. Changes to these Terms

We may update these Terms. If a change is material, we will provide reasonable notice through the Service or your contact information before it takes effect. The effective date above shows when these Terms were last updated. Continuing to use the Service after updated Terms take effect means you accept them; if you do not agree, you must stop using the Service.

15. General terms

These Terms, the Privacy Policy, and the Email & SMS Terms are the entire agreement about the Service. If any provision is unenforceable, it will be modified only as much as necessary and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, financing, reorganization, or sale of the Service. Headings are for convenience only.
