Terms of Service

1. Who may use PorchPing

You must be at least 13 years old and legally able to agree to these Terms. If you are under the age of legal majority where you live, you may use PorchPing only with the agreement of a parent or legal guardian. The Service is intended for people in the United States.

2. What PorchPing does

PorchPing helps residents follow selected public meeting agendas. You choose supported communities and topics, and we may email you when reviewed agenda items appear to match those choices. Coverage is limited to the communities, public bodies, meetings, records, and topics we support and may change over time. The resident service is currently free.

PorchPing may use automated tools to extract, classify, and explain public meeting material, followed by operator review before an alert is approved. Automated tools and people can make mistakes. An alert may be incomplete, delayed, unavailable, or inaccurate. The linked government record—not PorchPing’s explanation—is the official source.

3. Important limits

PorchPing does not provide legal, financial, land-use, real-estate, safety, or other professional advice. We do not guarantee that an alert covers every meeting, document, change, deadline, vote, or topic that may matter to you. Confirm meeting details, deadlines, legal notices, and official action directly with the relevant public body.

Do not rely on PorchPing for emergencies, evacuation notices, severe-weather warnings, public-safety instructions, statutory notice, service of process, or any other time-sensitive government communication. Call 911 or use official emergency and government channels when appropriate.

4. Your account

You agree to provide accurate information, keep control of the email account used to access PorchPing, and tell us promptly if you believe your account or private sign-in link has been used without permission. You are responsible for your choices and activity through your account.

You may change communities and topics, pause alerts, unsubscribe, or ask us to delete your account. Our Email Terms explain alert and account-message choices.

5. Acceptable use

You may not use the Service to break the law; impersonate another person; harass, threaten, or profile another person; violate privacy or intellectual-property rights; interfere with or overload the Service; bypass access controls; introduce malicious code; or misrepresent a PorchPing explanation as an official government record or communication.

You may not scrape or use automated means to access nonpublic parts of the Service, reverse engineer the Service except where law permits, resell access, or use PorchPing’s original content or outputs to build or train a competing product or model without our written permission. These restrictions do not limit lawful access to the underlying public records from their official sources.

6. Public records and third-party services

Government agendas, packets, attachments, and other public records remain attributable to their sources and may be subject to separate rights or terms. The Service also depends on third-party hosting, email delivery, public websites, and networks. We do not control and are not responsible for third-party content, availability, security, or practices.

7. PorchPing content, software, and feedback

VoteVoteWin LLC and its licensors own the Service’s software, design, branding, and original content. Subject to these Terms, we give you a limited, personal, revocable, nonexclusive, nontransferable right to use the Service for its intended purpose.

If you submit feedback or suggestions, you allow us to use them to operate and improve PorchPing without payment or restriction. This permission does not transfer ownership of your personal information or override the Privacy Policy.

8. Suspension, termination, and service changes

You may stop using PorchPing at any time. We may suspend or terminate access when reasonably necessary to address misuse, security risk, legal exposure, or a violation of these Terms. We may change, limit, or discontinue the Service. When reasonably practical, we will give notice of a material change that adversely affects current users.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” VoteVoteWin LLC disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, completeness, availability, and security. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, VoteVoteWin LLC and its owners, affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, opportunities, or use, arising from or related to the Service, even if advised that such damages are possible.

To the fullest extent permitted by law, their total liability for all claims arising from or related to the Service will not exceed the greater of $100 or the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

11. Indemnity

To the extent permitted by law, you will indemnify and hold harmless VoteVoteWin LLC and its owners, affiliates, officers, employees, contractors, and agents from third-party claims, losses, and reasonable legal fees arising from your unlawful misuse of the Service, violation of these Terms, or infringement of another person’s rights.

12. Governing law and disputes

Florida law governs these Terms without regard to conflict-of-laws rules. Before filing a claim, each party agrees to send written notice describing the dispute and requested relief and allow 30 days for an informal resolution. A dispute not resolved informally must be brought in the state or federal courts serving Bay County, Florida, and each party consents to their jurisdiction. Either party may seek emergency injunctive relief or use small-claims court where eligible.

These Terms do not require arbitration or waive the right to participate in a class action.

13. Changes to these Terms

We may update these Terms. If a change materially affects current users, we will provide reasonable notice through the Service or by email before the change takes effect when required. The effective date above identifies the current version. If you do not agree to updated Terms, you must stop using the Service.

14. General terms

These Terms, the Privacy Policy, and the Email Terms are the entire agreement about the Service. If a provision is unenforceable, it will be modified only as much as necessary and the remainder will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a financing, merger, reorganization, or sale of the Service or its assets.
